These Terms of Use ("ToU") constitute a legally binding agreement between you ("User," "you," or "your") and The Imperfect Self FZ-LLC (referred to herein as "The Imperfect Self," "Company," "we," "us," or "our"), a Free Zone Limited Liability Company registered in the Dubai World Trade Centre Free Zone, UAE.

By accessing, browsing, or otherwise using our website (www.theimperfectself.com), joining our early access list, or engaging with any of our content, tools, or services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these ToU, our Privacy Policy, and our Cookie Policy, each of which is incorporated herein by reference.

1. WHO WE ARE AND OUR MISSION

The Imperfect Self is a conscious technology company dedicated to exploring personal growth through AI, reflection, and human connection. Our mission is to help individuals live more freely and authentically.

2. NATURE OF THE PLATFORM AND DISCLAIMER OF PROFESSIONAL ADVICE

2.1. The content, tools, AI reflections, and early-access programs provided on the Platform are designed solely for self-reflection, educational, and informational purposes.

2.2. WE DO NOT PROVIDE MEDICAL, PSYCHOLOGICAL, THERAPEUTIC, LEGAL, FINANCIAL, OR ANY OTHER FORM OF PROFESSIONAL ADVICE. All content, including AI reflections or user prompts, should be understood as invitations to self-inquiry and personal exploration, not as a substitute for professional diagnosis, treatment, or consultation. You are solely responsible for how you interpret and apply the information and tools provided on the Platform. If you require professional advice or assistance, you should consult with a qualified professional.

2.3. The User acknowledges that we do not owe them a professional duty of care, fiduciary obligation, or therapeutic responsibility. Use of the Platform creates no clinician–patient or advisor–client relationship.

2.4. We make great efforts to ensure that all information on the website is comprehensive and error-free, and we periodically review the content, information, and any other data of any kind included in the website. However, you acknowledge and accept that all data available on the website is provided for information purposes only, and that the Company does not warrant nor accept any liability for any errors existing in the information. Notwithstanding, the Company will take measures to secure the accuracy of the data available on the website and to update them to the extent possible. All Service descriptions and pricing are subject to change at any time without notice, at our sole discretion. Additionally, we reserve the right to discontinue any Services at any time. We recommend that you search from time to time for updates of, or amendments to, the contents of the website.

3. ELIGIBILITY AND USER REPRESENTATIONS

By using the Platform, you represent and warrant that:

You are at least 18 years of age, or if you are a Minor, you have the express permission of a parent or legal guardian to use the Platform, and your parent or guardian agrees to be bound by these ToU.
You have the legal capacity to enter into and comply with these ToU.
You will not access the Platform through automated or non-human means, whether through a bot, script, or otherwise.
Your use of the Platform does not violate any applicable law or regulation.
You will not use the Platform in any manner intended to obtain personal, psychological, or emotional guidance for third parties, nor will you share Platform outputs as professional assessments or diagnostic tools.
You will not engage in manipulation, adversarial prompting, or any actions seeking to compromise the safety, accuracy, or limitations of the AI systems powering the Platform.

4. INTELLECTUAL PROPERTY RIGHTS

4.1. All content on the Platform, including, but not limited to, text, graphics, images, software, source code, databases, functionality, website design, audio, video, frameworks, logos, and AI reflections (collectively, "Company Content"), is the proprietary property of The Imperfect Self FZ-LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws of the UAE and international conventions.

4.2. You may not reproduce, redistribute, sell, license, or otherwise exploit any Company Content without our express prior written permission. Any unauthorized use of the Company Content constitutes a breach of these ToU and may violate applicable intellectual property laws.

4.3. You shall not use, publish, or train AI systems on any Company Content without obtaining prior written authorization. Any attempt to extract datasets, prompts, models, or derivative insights from the Platform for commercial or developmental purposes is strictly prohibited.

5. USER RESPONSIBILITIES AND PROHIBITED ACTIVITIES

5.1. You agree to use the Platform only for lawful, personal, non-commercial purposes and in a manner that does not infringe the rights of, restrict, or inhibit the use and enjoyment of the Platform by any third party.

5.2. You agree not to:

Upload, share, or transmit any content that is harmful, offensive, defamatory, obscene, sexually explicit, threatening, abusive, harassing, or otherwise objectionable.
Engage in any activity that disrupts, overloads, or otherwise damages the Platform or the servers and networks connected to the Platform.
Attempt to gain unauthorized access to any part of the Platform, other user accounts, or computer systems or networks connected to the Platform.
Use the Platform to send unsolicited or offensive messages, or for any fraudulent or unlawful purpose.
Violate the privacy and confidentiality of other community members.
Incite any third party to commit crimes or any illegal act.

5.3. We reserve the right to suspend or remove your access to the Platform for any behavior that violates these principles or disrupts our community’s safety and integrity, as determined in our sole discretion, without prejudice to any additional right to claim damages. In addition, we reserve the right to remove, suspend, restrict, or permanently erase User Content that is harmful, misleading, or incompatible with the Platform’s mission, or which creates legal exposure for the Company in any jurisdiction.

6. USER-GENERATED CONTENT

You are solely responsible for any content, data, text, or information that you upload, post, or transmit through the Platform ("User Content"). You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use your User Content as necessary to provide the Platform services and only for this purpose.

6.1. By posting or submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in connection with the operation of the Platform and our business. (if applicable)

7. PRIVACY AND DATA PROTECTION

We collect and process personal information in accordance with our separate Privacy Policy and Cookie Policy. By using the Platform, you consent to the collection, use, and processing of your information as described in those policies, and to the secure processing of your information in compliance with applicable data protection standards, including the UAE Federal Decree-Law No. 45 of 2021 (PDPL) and the European Union's General Data Protection Regulation (GDPR), where applicable. The Company may refuse certain requests of the User where disclosure would jeopardize system security or infringe the rights of other users.

8. DISCLAIMERS AND WARRANTIES

8.1. THE PLATFORM AND ALL CONTENT, TOOLS, AND AI REFLECTIONS ARE PROVIDED ON AN "AS IS"AND "AS AVAILABLE" BASIS.

8.2. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, CORRESPONDENCE WITH DESCRIPTION, SATISFACTORY QUALITY, AND NON-INFRINGEMENT. We make no guarantees regarding the accuracy, completeness, reliability, or suitability of the content for your individual circumstances.

8.3. The User expressly acknowledges that any reliance placed on AI-generated reflections or interpretive outputs is undertaken entirely at their own risk. The Company shall not be responsible for any decisions, actions, omissions, or interpretations made by the User based on the Platform content.

8.4. The User acknowledges that the Platform is not designed to identify, treat, or manage mental health conditions, emotional crises, or psychological symptoms. The Company reserves the right to restrict or terminate access if User behavior indicates safety concerns or misuse of the Platform as a substitute for professional assistance.

9. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE IMPERFECT SELF FZ-LLC, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES, ARISING FROM YOUR USE OF THE PLATFORM, OUR TOOLS, OR AI-GENERATED CONTENT.

10. LINKS TO THIRD PARTIES’ WEBPAGES

We are not liable for websites and contents provided by third parties and linked or embedded in the website or the Services, either as advertisement banners or otherwise included in any of the contents. We shall have no obligation to review the contents of said webpages and the services or products that third parties may offer through them, and their existence does not imply that we support, promote, endorse, sponsor, guarantee, or recommend the linked websites, contents, services, or products. You acknowledge that terms and conditions may apply to the access and use of said services, products, and websites, and that you are responsible for reviewing and accepting them.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless The Imperfect Self FZ-LLC, its officers, directors, employees, agents, and third-party partners, from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with:

Your access to or use of the Platform.
Your violation of these ToU.
Your violation of any third-party right, including without limitation any intellectual property right or privacy right.
Any User Content you post or submit.

12. MODIFICATIONS AND AMENDMENTS

We reserve the right, at our sole discretion, to update, change, or replace any part of these ToU at any time. We will notify you of any changes by updating the "Last Updated" date of this ToU. Your continued use of the Platform following the posting of any changes constitutes acceptance of those revised terms and shall be interpreted as waiver of your rights to object to the changes, updates or replacements of any part of these ToU.

Moreover, the Company may implement emergency updates or suspend certain functionalities without prior notice if required for security, safety, regulatory compliance, or system integrity.

13. GOVERNING LAW AND DISPUTE RESOLUTION

These ToU shall be governed by and construed in accordance with the laws of the Dubai and the Federal Laws of the United Arab Emirates, without regard to its conflict of law principles. Nothing in these Terms shall prevent the Company from seeking injunctive, interim, or urgent protective relief in any jurisdiction where the User violates IP rights, misuses data, or harms the Company’s commercial interests.

13.1. Any dispute, controversy, or claim arising out of or relating to these ToU, or the breach, termination, or invalidity thereof, shall be settled by the competent courts of the Dubai, UAE.

14. MISCELLANEOUS

14.1. If any provision of these ToU is found to be unlawful, void, or unenforceable, that provision is deemed severable from these ToU and does not affect the validity and enforceability of any remaining provisions.

14.2. Our failure to exercise or enforce any right or provision of these ToU shall not operate as a waiver of such right or provision.

14.3. These ToU, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and The Imperfect Self FZ-LLC concerning your use of the Platform.
